Shyftr, here’s your DMCA take-down notice
No one from Shyftr has contacted me in response to my emailed requests to remove my feed from their site. It seems they care as little about customer service as they care about copyright. I emailed them on Saturday afternoon and asked them to remove my feed within 48 hours. That deadline is now up, and the full posts from my feed are still up on their website. Since I have no other course of action, a DMCA take down notice is due, as promised.
Here it is. I blurred out my mailing address for privacy reasons. I’m going to mail the take down notice via certified mail to the address listed for them at Network Solutions. I’m also going to email it to them. They list no contact information whatsoever on their website other than the feedback email address (feedback@shiftr.com). They have no listed address, no people are named — talk about transparency and honesty…
Shyftr, I don’t know who runs you, and you know what, that says plenty about you as a company… All I know is that you’re infringing upon my copyright, and I’m not going to let you play fast and loose with my content. You don’t own it, you don’t have permission to use it, and you’re not going to build your business with it. If you don’t change your thieving ways (and no, your so-called policy change over this past weekend doesn’t count), I hope you go under as a business, as you rightly deserve. You’re not a feed reader, you’re a glorified splog.
I encourage those of you who are uncomfortable or unhappy with the way Shyftr is treating your content and hard work to submit similar DMCA take-down notices.
Updated 4/15/08: As of this morning, Shyftr has removed my feed content from their site. The DMCA take down notice has had the desired effect. I’ve been under constant stress since I found out about this. Perhaps now I’ll be able to get a good night’s sleep again.

To ask a quick question, why did you send the DMCA notice to Shyftr itself? Typically DMCA notices go to the host and since it is Shyftr’s own service that is doing the scraping and posting, not the direct action of a user, it would make more sense, from what I see, to send it to their host.
If you are interested in dropping them a copy of the notice, the email address, as far as I can tell, is abuse at transbeam dot com.

You make a great point, Jonathan! Fortunately, it looks like the DMCA notice has had the desired effect. If you visit the page where my full content used to be displayed until now, the following message is given: “We are unable to display this feed.” I for one am glad things have worked out and my copyright is now respected.

Raoul: Well, as long as it is resolved, I’m not going ot push the issue. Still, I guess to anyone interested in doing the same, they might want to consider the email address I provided above to see if it can help.
Remember, under the DMCA, if a client is a “repeat infringer” the host is required to ban them in order to preserve their safe harbor.
It could be a powerful tool against a site like Shyftr…
